Terms and Conditions

Welcome to RossFilms. These Terms and Conditions (“Terms”) govern your access to and use of the RossFilms website, platform, applications, services, and digital content (collectively, the “Platform”).

By accessing, browsing, registering on, or using the Platform, or by purchasing or accessing any movie, film, trailer, or other digital content through the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

If you do not agree with any of these Terms, please do not use the Platform or purchase any content through it.

1. Definitions

For the purposes of these Terms:

  • “RossFilms”, “we”, “us”, or “our” means RossFilms and its authorized representatives.
  • “User”, “you”, or “your” means any person who accesses or uses the Platform.
  • “Platform” means the RossFilms website, applications, and related digital services.
  • “Content” means movies, films, trailers, videos, images, audio, artwork, promotional material, and other digital content made available through the Platform.
  • “Transaction” means any purchase, payment, subscription, rental, or other paid transaction completed through the Platform.
  • “Viewing Period” means the period for which a User is permitted to access purchased Content, as specified on the Platform at the time of purchase.

2. Eligibility

You must be legally capable of entering into a binding agreement under applicable law to use the Platform or complete a Transaction.

If any Content has an age restriction, you must meet the applicable age requirement before accessing or purchasing such Content.

By using the Platform, you confirm that the information provided by you is accurate, complete, and up to date.

3. Account Registration

Certain features of the Platform may require you to create an account or provide personal information.

You are responsible for:

  • Providing accurate and complete information;
  • Maintaining the confidentiality of your login credentials;
  • Keeping your account information updated;
  • All activities carried out through your account; and
  • Immediately notifying RossFilms of any unauthorized access or suspected misuse of your account.

RossFilms reserves the right to suspend or terminate an account where we reasonably believe that the account has been used in violation of these Terms or applicable law.

4. Digital Content and Movie Access

RossFilms may provide Users with access to movies, films, trailers, and other digital Content through the Platform.

Certain Content may be available for free, while other Content may require payment.

Before completing a Transaction, the Platform will display relevant information such as:

  • Content title;
  • Description;
  • Applicable price;
  • Payment terms;
  • Viewing Period or access duration, where applicable; and
  • Other applicable conditions.

Users should carefully review this information before completing a Transaction.

5. Trailer and Preview

RossFilms may provide trailers, previews, or promotional clips before a User purchases or accesses a movie.

Watching a trailer or preview does not provide the User with any ownership rights in the underlying Content.

Access to the full movie or other paid Content may require the User to complete the applicable payment or Transaction.

6. Purchase and Payment

When you complete a Transaction on the Platform, you agree to pay the applicable amount displayed at the time of purchase.

Once payment is successfully completed, RossFilms may provide access to the purchased Content in accordance with the applicable terms.

Payments may be processed through third-party payment gateways. By making a payment, you agree to comply with the applicable terms and conditions of the relevant payment service provider.

RossFilms does not store sensitive payment information such as complete card numbers, CVV numbers, or banking credentials unless expressly stated and legally permitted.

7. Confirmation and Access Link

After successful completion of a Transaction, RossFilms may send a confirmation and/or Content access link to the email address provided by the User.

The User is responsible for providing a valid and accessible email address.

RossFilms shall not be responsible for delays or failure in receiving an email caused by:

  • Incorrect email information;
  • Spam or junk-mail filters;
  • Email service provider issues;
  • Full or inaccessible mailboxes; or
  • Other circumstances outside RossFilms' reasonable control.

The User should not share the access link with any other person.

8. Viewing Period

Certain movies or Content may be provided for a limited period after successful payment.

The applicable Viewing Period will be displayed on the Platform before or at the time of purchase.

For example, where a movie is offered with a 3-hour viewing period, the viewing period may begin from the time specified by RossFilms following successful payment and may expire automatically after the applicable duration.

Once the Viewing Period expires, access to the Content may be automatically disabled.

The User does not acquire permanent ownership of the digital Content merely by purchasing access to it.

9. Personal and Limited Use

Content purchased or accessed through RossFilms is provided for personal, non-commercial use only, unless RossFilms expressly permits otherwise in writing.

You must not:

  • Copy, reproduce, duplicate, or redistribute Content;
  • Download or record Content where downloading or recording is not expressly permitted;
  • Share, sell, rent, sublicense, or transfer access to another person;
  • Broadcast or publicly display Content;
  • Upload Content to another website, social media platform, file-sharing service, or other platform;
  • Circumvent technical restrictions or access controls;
  • Attempt to remove watermarks, copyright notices, or other protection mechanisms; or
  • Use Content for commercial purposes without prior written authorization.

10. Prohibited Activities

Users must not use the Platform for any unlawful, fraudulent, abusive, or unauthorized purpose.

You must not:

  • Violate any applicable law or regulation;
  • Attempt to gain unauthorized access to the Platform or another User's account;
  • Interfere with the operation or security of the Platform;
  • Introduce viruses, malware, malicious code, or harmful material;
  • Use automated systems to scrape, copy, or collect Platform Content without authorization;
  • Circumvent payment, access, or viewing restrictions;
  • Misuse refund or cancellation procedures;
  • Engage in fraudulent payment activity; or
  • Infringe the intellectual property or other rights of RossFilms or third parties.

11. Intellectual Property Rights

All Content available on the Platform, including but not limited to movies, videos, trailers, logos, trademarks, graphics, images, text, designs, software, and other materials, is owned by or licensed to RossFilms or its respective content owners.

Nothing in these Terms transfers ownership of any intellectual property rights to the User.

Subject to these Terms and any applicable payment, the User receives only a limited, non-exclusive, non-transferable, revocable right to access and view the purchased Content during the applicable Viewing Period.

Unauthorized use, reproduction, distribution, or exploitation of Content may constitute an infringement of applicable intellectual property laws.

12. User-Generated Content

If the Platform allows Users to submit reviews, comments, ratings, feedback, images, or other material, the User must ensure that such material:

  • Is lawful and accurate;
  • Does not infringe any third-party rights;
  • Does not contain defamatory, abusive, obscene, threatening, or unlawful material;
  • Does not contain malicious code or harmful content; and
  • Does not violate the privacy of another person.

RossFilms reserves the right to remove or restrict User-generated Content that violates these Terms or applicable law.

13. Availability of the Platform

RossFilms will make reasonable efforts to keep the Platform and Content available; however, we do not guarantee that the Platform will always be uninterrupted, error-free, secure, or available.

Access may occasionally be affected by:

  • Maintenance;
  • Technical failures;
  • Internet or network problems;
  • Server or hosting issues;
  • Payment gateway failures;
  • Third-party service interruptions; or
  • Circumstances beyond our reasonable control.

We may modify, suspend, restrict, or discontinue any part of the Platform or Content at any time, subject to applicable law.

14. Third-Party Services

The Platform may use or integrate third-party services, including payment gateways, email services, hosting providers, analytics services, and other technology providers.

Your use of such services may be subject to the respective third party's terms and privacy policies.

RossFilms is not responsible for the acts, omissions, availability, or technical failures of third-party services beyond its reasonable control.

15. Refund and Cancellation

Refunds and cancellations are governed by the RossFilms Refund and Cancellation Policy, which forms part of these Terms.

Users should review the applicable Refund and Cancellation Policy before completing a Transaction.

Unless otherwise stated on the Platform or required by applicable law, a User may not be entitled to a refund merely because they change their mind, fail to watch the Content, or do not use the entire Viewing Period.

16. Pricing and Errors

RossFilms makes reasonable efforts to ensure that pricing and Content information displayed on the Platform is accurate.

However, in the event of an obvious pricing, technical, or Content-related error, RossFilms reserves the right to correct the error and take appropriate action, subject to applicable law.

If a Transaction has been affected by an obvious technical or pricing error, RossFilms may contact the User regarding the Transaction and, where appropriate, provide a refund.

17. Privacy

Your use of the Platform is also subject to the RossFilms Privacy Policy.

By using the Platform, you acknowledge that RossFilms may collect, process, store, and use information in accordance with its Privacy Policy and applicable law.

18. Disclaimer

To the maximum extent permitted by applicable law, RossFilms does not guarantee that:

  • The Platform will always be available or uninterrupted;
  • Content will always be available at all times;
  • The Platform will be completely free from technical errors;
  • The Platform will be compatible with every device or operating system; or
  • The Platform will meet every User's individual requirements.

Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited under applicable law.

19. Limitation of Liability

To the maximum extent permitted by applicable law, RossFilms shall not be liable for indirect, incidental, special, consequential, or other losses arising from the use of the Platform or Content, including losses resulting from interruptions, technical failures, or unauthorized access beyond RossFilms' reasonable control.

Nothing in these Terms shall limit liability where such limitation is prohibited under applicable law.

20. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless RossFilms, its affiliates, officers, employees, representatives, licensors, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from:

  • Your violation of these Terms;
  • Your misuse of the Platform;
  • Your infringement of third-party rights; or
  • Your violation of applicable laws or regulations.

21. Suspension or Termination

RossFilms may suspend or terminate your access to the Platform or your account if:

  • You breach these Terms;
  • You engage in fraudulent or unlawful activities;
  • You attempt to circumvent Platform security or payment controls;
  • You misuse Content or access rights; or
  • Such action is otherwise reasonably necessary to protect RossFilms, its Users, or third parties.

Termination or suspension shall not affect any rights or obligations that accrued before termination.

22. Changes to These Terms

RossFilms may update or modify these Terms from time to time.

Any revised Terms will be published on the Platform with an updated “Last Updated” date.

Your continued use of the Platform after the revised Terms become effective constitutes your acceptance of the updated Terms.

23. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India.

Subject to applicable law, disputes arising out of or relating to these Terms or your use of the Platform shall be subject to the jurisdiction of the courts located in Pune, Maharashtra, India.
